Terms of Service

Last updated 2026-05-13 · EpochCore LLC · Not legal advice. Consult counsel for your jurisdiction.

These Terms of Service ("Terms") govern your use of the EU AI Act Compliance service operated by EpochCore LLC ("EpochCore", "we"). By using the service you agree to these Terms.

1. Service

The service produces tamper-evident, chain-anchored evidence supporting your obligations under the EU AI Act (Regulation (EU) 2024/1689), in particular Articles 12, 15, and 17. The verifier endpoint is operated independently and is open to any third party at no cost.

2. Plans and billing

3. Your data

You retain all rights to the agent decisions you submit. The Data Processing Agreement (see DPA) governs processing of personal data. Envelope artifacts (hashes, signatures, chain anchors) are by design publicly verifiable; the underlying decision payload is not stored in plaintext on our infrastructure unless you explicitly enable payload retention as part of an Enterprise SOW.

4. Acceptable use

You agree not to (a) submit content that is unlawful in your jurisdiction, (b) attempt to subvert the verifier chain, (c) probe our infrastructure beyond the API surface, or (d) resell the service without a written reseller agreement.

5. Compliance posture and limitations

The service produces evidence supporting EU AI Act technical clauses. It is not a substitute for: (a) qualified-counsel conformity assessment route selection, (b) provider obligations under Articles 16, 18, 19, 22, 23, 47, 49, and 72, (c) deployer obligations under Article 26, or (d) notified-body involvement where required. EpochCore does not represent that the service itself holds any certification on your behalf; attestation mapping is available on request.

6. Warranty and liability

The service is provided "as is" to the maximum extent permitted by law. EpochCore disclaims implied warranties. EpochCore's aggregate liability for any claim is limited to the fees paid in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (including, where applicable, mandatory EU consumer-protection law).

7. Termination

We may suspend or terminate access for material breach with notice where practicable. On termination, you remain entitled to verify previously issued envelopes through the public verifier.

8. Governing law and venue

These Terms are governed by the laws of the State of Delaware, USA. Where applicable EU consumer law gives you mandatory protections that cannot be derogated from by contract, those protections continue to apply. Disputes lie in the state or federal courts of Delaware, save where EU mandatory venue rules require otherwise.

9. Changes

We may update these Terms. Material changes will be announced via the email on file and reflected in the "Last updated" date above. Continued use after the effective date constitutes acceptance.
